A Note Before the Legal Language
We built Always Human Hospice Consulting to serve people doing some of the hardest, most sacred work there is. These Terms exist to keep that relationship clear and fair — so you know what you can expect from us, and what we ask of you. Please read them. By using our website, purchasing our products, or engaging our services, you're agreeing to what follows.
1. Acceptance of These Terms
These Terms and Conditions ("Terms") govern your access to and use of the website always-human.com and its subdomains, our digital products, and our online content (collectively, the "Services"), operated by Always Human Hospice Consulting LLC ("Always Human," "AHHC," "we," "us," or "our").
By accessing or using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Services.
2. Eligibility
You must be at least 18 years old and able to form a legally binding contract to use the Services or make a purchase. By using the Services, you represent that you meet these requirements.
3. Our Services and Content
Always Human provides sales training, consulting, coaching, educational resources, digital products, and related content for the hospice, palliative care, and serious-illness community. The Services may include:

Downloadable digital products (guides, toolkits, field tools, and similar materials);

Newsletters, courses, and other educational communications;

Coaching, consulting, and professional engagements arranged separately.
We may modify, suspend, or discontinue any part of the Services at any time without notice.
4. Educational Purpose — No Professional, Medical, Legal, or Financial Advice
This is important. Please read carefully.
Our content and products are provided for general educational and informational purposes only. They are intended to support professional development and to help individuals understand the end-of-life care landscape. They are not a substitute for, and should never be relied upon as:

Medical or clinical advice. Nothing in the Services constitutes medical advice, diagnosis, or treatment. Always consult a qualified physician, hospice or palliative care provider, or other licensed healthcare professional regarding medical decisions, patient care, or any health condition.

Legal, financial, tax, or accounting advice. Consult a qualified professional for advice specific to your situation.

A professional, clinical, or fiduciary relationship. Using our website, reading our content, or purchasing a product does not create a consultant–client, coaching, clinician–patient, or advisory relationship. Such relationships are formed only through a separate, signed engagement agreement.
You are solely responsible for any decisions or actions you take based on our content. Always Human is not responsible for the care, decisions, or outcomes of any patient, family, organization, or individual.
5. Results and Testimonials Disclaimer
Any results, metrics, case studies, or testimonials we share — including examples of growth or performance achieved by us or our clients — reflect specific circumstances and are not guarantees, promises, or predictions of the results you will achieve. Outcomes depend on many factors outside our control, including your effort, market conditions, team, and execution. We make no guarantee of any particular result.
6. Purchases and Digital Products
Orders and Payment
When you purchase a product, you agree to provide accurate, current payment information and authorize us and our payment processor (e.g., Stripe / Wix Payments) to charge the applicable amount. All prices are in U.S. dollars unless stated otherwise. We may change prices at any time, but changes will not affect orders already placed.
License to Use Digital Products
When you purchase a digital product, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use it for your own personal or internal business use only. Unless a product's license expressly permits otherwise, you may not:

Resell, redistribute, sublicense, share, or publicly post the product;

Reproduce it for use beyond the seats or scope you purchased;

Use it to create competing training, coaching, or educational materials.
We retain all ownership of the digital products (see Section 8).
Delivery
Digital products are delivered electronically. It is your responsibility to provide a valid email address and to download or access the product as instructed.
Refunds

7. Coaching, Consulting, and Professional Engagements
Coaching, consulting, fractional, and other professional engagements are governed by a separate written agreement (such as a proposal, statement of work, or engagement letter) between you or your organization and Always Human. Where those agreements conflict with these Terms, the signed engagement agreement controls for that engagement. Scheduling a discovery call or consultation through our website does not by itself create a binding engagement.
8. Intellectual Property
All content on the Services — including text, graphics, logos, frameworks, methodologies, course materials, toolkits, templates, video, and the selection and arrangement of all of the above — is owned by or licensed to Always Human Hospice Consulting LLC and is protected by U.S. and international intellectual property laws.
This includes our proprietary frameworks, models, and branded methodologies (for example, our See. Stay. Lead. framework, The Always Human Standard, and our C.A.R.E.S. and Sacred Conversations frameworks), as well as the names, logos, and trademarks associated with Always Human.
Except for the limited license expressly granted in these Terms or in a product license, you may not copy, reproduce, distribute, modify, publicly display, create derivative works from, or commercially exploit any of our content without our prior written permission.
9. Your Submissions and Communications
If you submit feedback, ideas, questions, survey responses, or other content to us, you grant Always Human a non-exclusive, royalty-free, worldwide license to use it to operate and improve our Services, without obligation to you. Please do not submit confidential information or protected health information (see our Privacy Policy). You are responsible for ensuring you have the right to share anything you send us.
10. Acceptable Use
You agree not to:

Use the Services for any unlawful, harmful, or fraudulent purpose;

Infringe the intellectual property or privacy rights of others;

Attempt to gain unauthorized access to our systems or interfere with the Services;

Upload viruses or malicious code;

Scrape, harvest, or collect data from the Services without permission;

Misrepresent your identity or affiliation.
We may suspend or terminate your access for any violation of these Terms.
11. Third-Party Links and Services
The Services may contain links to or integrations with third-party websites, tools, and platforms that we do not control. We are not responsible for their content, products, or practices. Your use of third-party services is governed by their own terms and policies.
12. Disclaimer of Warranties
THE SERVICES, CONTENT, AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, secure, or that any content is accurate, complete, or current.
13. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, ALWAYS HUMAN HOSPICE CONSULTING LLC AND ITS OWNERS, EMPLOYEES, AND CONTRACTORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
IN NO EVENT WILL OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICES EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR ONE HUNDRED U.S. DOLLARS ($100), WHICHEVER IS GREATER.
Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Always Human Hospice Consulting LLC and its owners, employees, and contractors from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your violation of these Terms, or your violation of any law or the rights of a third party.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in [County], Texas, and you consent to the jurisdiction of those courts.

18. Miscellaneous

Entire agreement. These Terms, along with our Privacy Policy and any signed engagement agreement, constitute the entire agreement between you and Always Human regarding the Services.

Severability. If any provision is found unenforceable, the remaining provisions stay in effect.

No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

Assignment. You may not assign these Terms without our consent; we may assign them in connection with a business transfer.

Digital Download Policy

By purchasing a digital product from Always Human Hospice Consulting LLC ("Always Human," "we," "us," or "our"), you agree to this Digital Download Policy, our Terms and Conditions, and our Privacy Policy.
1. What Counts as a Digital Product
This policy applies to all electronically delivered products we offer, including (but not limited to):

Guides, workbooks, and toolkits;

Field tools, scripts, and templates;

Micro-education kits and downloadable resources;
-
Bundles that combine any of the above.
Digital products are delivered as files (such as PDFs) or as digital access — they are never shipped physically.
2. How Your Download Is Delivered
After your payment is successfully processed, you will receive:

An order confirmation and receipt by email; and

A download link or access instructions — delivered on the confirmation screen and/or by email to the address you provided at checkout.
Delivery is typically immediate. If you do not receive your download within [15–30 minutes], please first check your spam or promotions folder, then contact us at nikki@always-human.com].

3. Accessing and Downloading Your Files

4. Technical Requirements
To use our digital products, you'll generally need:

It is your responsibility to confirm your device and software can open the files before purchasing. We are happy to answer compatibility questions in advance — just reach out.
5. License — How You May Use Your Purchase
When you buy a digital product, we grant you a limited, non-exclusive, non-transferable license to use it for your own personal or internal business use, consistent with the seats or scope you purchased.
Unless the product's listing or license expressly says otherwise, you may not:

Resell, rent, sublicense, or redistribute the product;

Share, post, or upload it publicly or to shared drives outside your purchased scope;

Reproduce it for an entire team, organization, or class beyond what you purchased;

Use it to create competing training, coaching, or educational materials;

Remove or alter any branding, copyright, or attribution.
All products remain the intellectual property of Always Human Hospice Consulting LLC. Team, site, and organizational licenses are available — contact us if you'd like to deploy a product across a group.
6. Refunds and Cancellations
Because our products are digital and delivered instantly, all sales are final and non-refundable once the product has been delivered or accessed, except where a refund is required by law. Technical problems are different. If you can't access or open a product because of a technical issue on our end, contact us at nikki@always-human.com and we will fix the problem or, if we can't, make it right.
7. Pricing and Payment

All prices are listed in U.S. dollars unless stated otherwise.

Payment is processed securely through our payment processor (e.g., Stripe / Wix Payments). We do not store your full payment card details.

We may update prices and product offerings at any time, but changes will not affect a purchase you've already completed.

You are responsible for any applicable taxes.
8. Product Updates
We may update or improve our digital products over time. Unless we state otherwise for a specific product, purchase of a product does not automatically entitle you to future versions, editions, or updates. If we offer free updates for a product, that will be noted in the product listing.
9. Prohibited Conduct
Sharing, copying, or distributing our digital products beyond your license is a violation of this policy and of our intellectual property rights, and may result in revoked access and legal action. We appreciate your respect for the work that goes into these resources.
10. Educational Purpose
